Welcome to www.thepitambara.com (“Website”). By using our website and services (“Services”), you agree to the following Terms and Conditions (“Terms”), our Privacy Policy, and all related policies referenced herein or through hyperlinks. Please read them carefully.

1. Acceptance of Terms

By accessing or using this Website, you acknowledge that you have read, understood, and consented to these Terms, including our Privacy Policy. We may revise these Terms at any time without prior notice. Continued use after updates constitutes your acceptance.

2. Intellectual Property & Content

  • Ownership: All content—including images, text, videos, artwork, software, trademarks, designs, and logos—is the exclusive property of Pitambara or its affiliates and is protected by Indian and international intellectual property laws.
  • Use of Photos: Product imagery features professional photoshoots as well as real brides in Pitambara ensembles. These are for representational purposes only.
  • Restrictions: No content may be copied, reproduced, distributed, or used for commercial purposes without written authorization, except for personal, non-commercial use.
  • Any suggestions, reviews, or content submitted by users may be used by Pitambara globally, without further obligation or royalty.

3. Product Catalog, Customisation & Made-to-Order Policy

  • Catalogue & Outfits: Pitambara offers both standard catalogue pieces and fully bespoke options via our website.
  • Customisation: Every Pitambara outfit (including bridal wear and special occasion ensembles) is individually designed and hand-crafted to client specifications—this covers body measurements, choice of fabric, design elements, embroidery, and finish.
  • Process:
    • Each custom order includes design sketches, embroidery references, and fittings, as relevant.
    • Once design and measurements are finalized and confirmed by the client, no changes can be made.
    • Every order is unique and not mass-produced.
    • Customization is subject to availability of fabric and design feasibility, and is at Pitambara’s discretion.

4. Measurement & Fittings

  • Accurate measurements, as required for the garment, must be shared at the time of order.
  • For clients in India, trial fittings may be offered at Pitambara’s discretion and in select locations.
  • Any alteration requests after delivery may incur charges and are subject to Pitambara’s approval.

5. Order, Pricing, Taxes & Billing

  • Order Confirmation: All orders are subject to confirmation and acceptance by Pitambara. Orders are only processed once full payment is received.
  • Pricing: All prices listed on the website are exclusive of international customs duties, import taxes, or charges, which vary by the recipient’s country and are the buyer’s responsibility.
  • Domestic Orders: Prices include Indian taxes.

6. No Returns/No Refunds/Cancellation Policy

Because couture is personal.
Every garment at Pitambara by Manisha is custom created for each client—therefore, WE FOLLOW A STRICT NO RETURN, NO CANCELLATION, AND NO REFUND POLICY for all orders, including standard catalogue and made-to-order pieces. Please ensure you have finalized your decision before placing an order.

  • No returns, exchanges, or refunds will be entertained for:
    • Change of mind after order placement or design/fitting approval.
    • Color, size, or slight design variation perceived due to display/device differences.
    • Any dissatisfaction based on subjective preferences once the final design is confirmed.
  • In rare circumstances (production defects, damages in transit), notify us within 24 hours of receiving the item; Pitambara reserves the right to inspect and determine the resolution (e.g., repair or replacement) at its sole discretion. No cash refunds or credit notes will be issued.

7. Shipping & Delivery

Every Pitambara creation is made with patience and precision. Here’s what to expect when your dream ensemble is on its way:

7.1 Production Time

  • Bridal Orders: 6 to 12 weeks, depending on design intricacy, embellishment, and sourcing requirements.
  • Festive or Pre-Bridal Orders: 3 to 6 weeks.
  • Urgent Orders: May be accommodated at extra charge, based on availability. Please contact us in advance.

7.2 Domestic Shipping (India)

  • All shipments within India are free for orders above ₹50,000.
  • Standard delivery is 2–5 business days post-dispatch.
  • Tracking details will be shared via email or WhatsApp once your order is shipped.

7.3 International Shipping

  • We ship worldwide via trusted premium services such as DHL, FedEx, UPS, or similar.
  • International delivery timeline: 5–12 business days after dispatch (customs clearance delays may apply).
  • Shipping charges vary by destination and weight and will be calculated at checkout.
  • Customs Duties, VAT & Import Taxes: These are the customer’s responsibility and are not included in the invoice or order total; they must be settled with your country’s authorities upon product arrival.

7.4 Shipping Responsibility

  • All parcels are quality-checked and securely packaged before dispatch.
  • Once your order is handed to the shipping provider, Pitambara is not liable for loss, delays, or damage caused by the courier or due to force majeure. However, we will provide full assistance in resolving such issues with logistics partners.

7.5 Delivery Address & Contact

  • Please ensure that accurate and complete delivery details are provided at the time of order.
  • Pitambara is not responsible for delivery failures resulting from incorrect address, incomplete information, or if the recipient cannot be contacted at the time of delivery.

8. Order Modifications

  • Any changes in design, measurements, or specifications cannot be accommodated once you have approved the final design or after the order is in production.
  • If you provide incorrect or incomplete measurements, Pitambara will not be responsible for resulting fit issues, and corrections (if feasible) will incur additional charges.

9. Limitation of Liability

Pitambara is not liable for:

  • Inaccuracies in client-provided measurements or information.
  • Delays caused by customs, unavoidable events, or third-party logistics.
  • Any dissatisfaction arising from a change of mind or subjective preferences post design/service approval.
  • Any indirect, incidental, or consequential damages as a result of using our Website or Services.

10. Indemnity

You agree to indemnify and hold harmless Pitambara, its affiliates, directors, agents, or employees from any claims or expenses (including legal fees) arising from your use of the Website, violation of Terms, or any third-party claims arising from your submissions or transactions.

11. Communication, Promotions & Newsletters

By using our Website, you consent to receive transactional and promotional updates from Pitambara by email or telephone. You may opt out at any time by following the unsubscribe instructions in the emails.

12. Third-Party Links

Pitambara is not responsible for the content or operation of third-party websites linked via our platform.

13. Force Majeure

Pitambara shall not be held liable for any failure to perform or deliver products due to events beyond reasonable control (including but not limited to natural disasters, government action, epidemic, strikes, or similar events).

14. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

16. Severability & Waiver
